Using this website
These terms govern use of the Martyanoff Studio public website. Use the website lawfully and respect the rights of others. If you submit an inquiry for a business, you should be authorised to communicate on its behalf. Questions about these terms can be sent to [email protected].
This website introduces professional services to business customers. It does not offer online checkout or create a paid engagement merely because you browse, submit a form or receive an initial response.
Inquiries and project agreements
An inquiry is a request for discussion, not a binding order or a promise that we will accept a project. Work begins only after the parties agree the relevant proposal or service agreement and any required initial payment.
The signed or otherwise expressly accepted project agreement controls the scope, deliverables, milestones, fees, acceptance process, confidentiality, intellectual property and termination of that project. If it conflicts with general website descriptions, the project agreement takes priority for that engagement. These website terms do not replace it.
Prices, schedules and scope
Published prices are starting estimates. The currency and final price are confirmed in your project proposal before work begins. A base website launch starts from $2,000 and typically takes 2–3 weeks. Neither figure is a fixed quote or guaranteed delivery date. Scope, content readiness, integrations and timely feedback affect the final proposal.
The base offer normally includes two revision rounds and 30 days of post-launch support, subject to the agreed proposal. New functionality, substantial rewrites, additional languages, advanced integrations, ongoing campaigns and extended support require separate agreement. Taxes, third-party charges, hosting, licences and recurring costs must be clarified in the proposal before commitment.
Payments, cancellation and handoff
Payments are arranged outside this website by invoice or an agreed payment service. Deposit amounts and payment dates are specified in the project agreement; standard launch projects usually require 30–50% upfront. Full handoff normally follows full payment, subject to that agreement.
Cancellation, refunds, suspension, ownership transfer and work completed before termination are governed by the project agreement and applicable law. These website terms do not impose a blanket non-refundable deposit or remove any mandatory cancellation or refund right.
Website content and intellectual property
Website text, design, code and visual assets belong to Martyanoff Studio or their respective licensors unless stated otherwise. You may view and share links to public pages for legitimate business purposes. You may not reproduce, resell or present protected material as your own without permission or another lawful basis.
Client names, logos and third-party trademarks remain the property of their owners. Portfolio descriptions illustrate selected work; development concepts and illustrations are labelled. A reference to a project, programme or technology does not imply endorsement or guarantee comparable results.
Any transfer or licence of project deliverables is defined by the project agreement. Third-party and open-source materials remain subject to their own licences.
Information you send us
Provide accurate contact information and only material you are entitled to share. You retain rights in your submission and allow us to use it to assess and respond to your inquiry. Do not submit passwords, confidential third-party records or sensitive personal data through the public form.
Sending a preliminary inquiry does not itself create a non-disclosure agreement. If information requires special confidentiality arrangements, agree those before sharing it. Personal information is handled as described in the Privacy Policy.
Acceptable use
Do not use the website to send spam, unlawful or abusive content, impersonate another person, infringe rights, distribute malware, interfere with availability, attempt unauthorised access or extract information in a way that violates applicable law.
We may restrict abusive requests or access where reasonably necessary to protect the website, other users or legal rights. This does not prevent legitimate security reporting, lawful research or use permitted by law.
Availability and external services
We aim to keep information accurate and the website available, but pages may contain errors or change, and access may be interrupted for maintenance or circumstances outside our control. Confirm important commercial details in your proposal.
External websites and services have their own terms. We do not control their availability, content or practices. Website descriptions are general information, not legal, tax or other regulated professional advice. We do not guarantee a particular ranking, revenue, traffic level or business outcome.
Responsibility and your legal protections
To the extent permitted by applicable law, the public website is provided on an “as available” basis without guarantees of uninterrupted or error-free operation. Responsibility for paid services is addressed in the relevant project agreement.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer and data protection rights remain unaffected even though our services are aimed at businesses.
Questions, disputes and updates
If you have a concern, contact [email protected] with the relevant details so we can try to resolve it. These website terms do not impose mandatory arbitration, a class-action waiver or an exclusive foreign court. Applicable mandatory law and access to competent courts remain unaffected; project-specific arrangements may be agreed separately subject to those protections.
We may revise these website terms and update the revision date. Changes do not retroactively alter an accepted project agreement. If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
